MINUTES OF THE PUBLIC MEETING OF NOVEMBER 9TH, 2004

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman in Meeting Room A in the Town Hall.

Old Business/New Business

Letter regarding donation of 7.46 acres at the corners of State and Brook Streets to Conservation  - Phil Lindquist read the letter to the Commission.  Ms. Delaney mentioned that it is adjacent to Conservation property.

Public Hearings

7:45 PM Notice of Intent for the demolition of and reconstruction of a house and the upgrade of a septic system at 62 Ocean Ave., Assessor’s Map 2 , Lot 1518 for Dean Anderson represented by John W. Delano and Assoc., Inc., 220 Hudson St., Halifax, MA  (New Hearing) DEP #175-0454

Craig Nicholson read the Public Hearing Notice and the green cards were checked.   Dean Anderson was present.  John Delano made the presentation.  He is currently in the process of a revision, but had photocopied the plan he’s working on to demonstrate that the wetland has been flagged and that the proposed house and garage are shown on the plan.  There are two septic systems proposed. One is for the cottage across the road.  A revised plan will be submitted to DEP with the dimensions of the new house if it is approved by Conservation.  Mr. Delano indicated that DEP will be okay with the system as long as there is to be no additional flow.  Mr. Anderson has proposed to pull all the items (cars, engine blocks, etc.) out of the wetlands.  Mr. Delano had received a letter from the agent and is working on addressing all of her concerns.  Phil Lindquist read the abutters list. Those present were:

Audrey Hayward, 60 Ocean Ave.:  She objects to Mr. Anderson going off the original footprint of the existing home.  Everybody down there that’s replaced a septic has had to stay on the same footprint.  The house and garage are too big for that area.  Seems ridiculous.  It’s in the wetlands.
Linda Hauge, 45 Ocean Ave.:  Stated that Mr. Anderson’s house and garage should be on the same footprint as the old one because there are wetlands all around and everybody else was told to stay on the same footprint.
Charles Montgomery, 71 Ocean Ave.:  Thought that Mr. Anderson should do what he wants.  It’s his property.
Steve Nicoletta, 61 Ocean Ave.:  Has no problem with plan.  It looks fine.  Ms. Delaney pointed out to Mr. Nicoletta that he is staying on the same footprint while doing renovations.  Mr. Nicoletta answered that he was restricted by the size of the lot.
Frank Runey, 22 Ocean Ave. (not an abutter):  It will improve the neighborhood and tax base.  He is all for it.
Audrey Hayward, 60 Ocean Ave.:  Mr. Anderson has never made an improvement for as long as he’s lived there.

Mr. Delano explained that Mr. Anderson has received approval from the Board of Appeals.  The existing cottage is in deplorable condition.  In order to come up with bank financing for the septic, it is necessary to increase the value of the property to acquire capital.   Mr. Lindquist asked that the driveway be shown on the plan if it is being proposed.

8:00 PM  Notice of Intent for the jacking up of a house for construction of a new foundation and the upgrade of the septic system at 51 Ocean Ave., Assessor’s Map 2, Lot 8A for Dean Anderson represented by John W. Delano & Associates, Inc., 220 Hudson St., Halifax, MA  02338  (New Hearing)  (DEP #175-0457)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  John Delano made the presentation.  The proposal calls for a new septic tank and pump chamber to the system  across the street at 62 Ocean Ave.. The pond will be protected with a silt fence.  Mr. Anderson is replacing the piers with a permanent foundation. The lot is very tight so Mr. Anderson will do the work by hand.  Ms. Delaney would like the existing dock shown on the plan for the record.  Phil Lindquist read the abutters list.  Those present were:

Audrey Hayward, 60 Ocean Ave.:  She is concerned about the road being chewed up by construction and whereas it’s a private road, who is responsible.  Mr. Delano answered that it will be a2” force main with a 6” PVC pipe sleeve with a foot of cover.  The excavation will be minimal and it will be backfilled and compacted.   As far as the rights go, as long as the private way is left open and access is provided, there is no restriction for going under the road.      
Linda Hauge, 45 Ocean Ave.:  Commented that if the grade is being raised, where is runoff going to go.  Mr. Delano answered that stormwater runoff will go towards the pond.
Charles Montgomery, 71 Ocean Ave.:  All set with what he’s doing.
Steve Nicoletta, 61 Ocean Ave.:  Great idea to lift up the house.

8:15 PM  Continued Notice of Intent for the extension of recently approved Deerhill Road including the construction of Fawn Lane creating 10 new residential lots.  Also, the installation of all necessary drainage, utilities and site grading for the creation of the new roadways.  Map 102, Lots 7 & 18A-4 for A.W. Perry South, Inc., 20 Winthrop St., Boston, MA  02110 represented by Merrill Associates, Inc., 427 Columbia Rd., Hanover, MA  02339.  (DEP #175-0452)

Peter Palmieri of Merrill Associates attended and submitted a revised plan showing the relocation of flags according to Dr. Walter Hewitson’s review of the wetland line.  The 50’ and 100’ line had been revised in places.  The plan had not been received in the office until last Friday.  Ms. Delaney had written a list of comments.  Bob Gray of Sebatia, Inc. gave a report on the Box Turtle sighting.  It is his opinion that it is not known if this was an individual turtle or representative of a population, so the developer is proposing to do some more monitoring in the spring.   Phil asked for comments from abutters.  There were no comments.

John Delano presented abutter notification and a letter from the Division of Fisheries and Wildlife.  A DEP # had been received.  Ms. Delaney had noticed a minor discrepancy in the flagging at the site from what was shown on the plan.  Mr. Delano will submit a revised plan with a new revision date.

It was decided that the bonds should be released and Certificates of Compliance issued to the original owner and developer, Ed Johnson as the conditions of the Orders of Conditions had been adhered to.  However, the Board decided to add an ongoing condition to the COC’s that the present owner’s not mow beyond what is being mowed now.  Also, they would like to speak to the owner of 7 Joshua Lane about the fence installed beyond the riverfront markers and his future plans.
